DMCA Policy

Overview
xfetchy ("we," "us," or "our") respects the intellectual property rights of others and expects users of our service to do the same. xfetchy operates as a tool that retrieves publicly accessible media URLs from X Corp.'s (formerly Twitter's) own CDN infrastructure. We do not host, store, cache, transcode, or permanently retain any video, audio, or image content on our servers. All media is delivered directly from X Corp.'s servers to the end user.
In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we have adopted the following policy regarding copyright infringement notices and counter-notices.

Submitting a DMCA Takedown Notice
If you believe that material accessible through xfetchy infringes a copyright you own or control, you may file a written notification with our Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:
- Identification of the copyrighted work — a description of the copyrighted work (or a list of works) that you claim has been infringed. If multiple works are covered by a single notification, you may provide a representative list.
- Identification of the infringing material — a description of the material you claim is infringing and its location (e.g., the specific URL on xfetchy.com that you used to access the content).
- Your contact information — your full legal name, mailing address, telephone number, and email address.
- Good-faith statement — a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Signature — your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).
Notices that do not comply with these requirements may not be acted upon. Sending a false DMCA notice may expose you to legal liability under 17 U.S.C. § 512(f).
Our Response
Upon receipt of a complete and valid DMCA notice, we will:
- Respond within 48 business hours.
- Take reasonable steps to disable access to the reported content through our service, or, where applicable, forward the notice to X Corp. as the content host.
- Notify the user, if identifiable, that access has been disabled.
Because xfetchy does not host the underlying content, the authoritative takedown action may need to be directed at X Corp. We will provide guidance on doing so in our response.
Counter-Notification
If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if outside the United States), and that you will accept service of process from the person who submitted the original DMCA notice.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore access to the content within 10–14 business days unless the complainant notifies us that they have filed a court action.
Repeat Infringer Policy
In appropriate circumstances, xfetchy will disable or block access for users who are determined to be repeat infringers of third-party copyrights, consistent with our obligations under 17 U.S.C. § 512(i).
Note on xfetchy's Architecture
xfetchy does not store copies of Twitter/X media. When you use xfetchy, our server retrieves a temporary, publicly accessible media URL from X Corp.'s CDN and returns it to your browser. The actual media file is downloaded by your browser directly from X Corp.'s servers (e.g., video.twimg.com). As such, the authoritative source of any Twitter/X content is X Corp., reachable at help.twitter.com/copyright-policy.
